These Terms of Use apply to Actualfeed and the services provided under the auspices of ADPI Group (USA). Any reference to “Actualfeed” in this document includes, as appropriate, ADPI Publishing, ADPI News, and ADPI Group (USA).
1. Acceptance of Terms
By accessing and using Actualfeed, you agree to be bound by these Terms of Use, which constitute a legally binding agreement between you and Actualfeed. If you are acting on behalf of an entity, you represent and warrant that you have the legal authority to bind that entity to these terms, and you agree to be held personally responsible in case of any violation. If you do not agree to these terms or are legally restricted from accessing such content under U.S. law, please cease using the site immediately.
2. Freedom of Expression and Content Moderation
Actualfeed supports freedom of expression and aims to be an open space for ideas. However, we strictly prohibit any content that:
• we believe violates the law, including intellectual property rights, or may be interpreted as incitement to hatred, harassment, or a threat to national security;
• we believe contains defamatory, obscene, or violence-inciting statements, or constitutes criminal behavior;
• we believe violates our community guidelines or poses a risk to the integrity of Actualfeed.
Actualfeed is not responsible for any statements or content posted by users, as protected under Section 230 of the Communications Decency Act (CDA). All opinions expressed are solely those of the author and do not represent Actualfeed.
User Confidentiality and Disclosure
Actualfeed respects the confidentiality of its users and is committed to safeguarding their privacy. Actualfeed will only disclose an author’s identity or personal information as a last resort and strictly under an irrevocable legal obligation in accordance with U.S. law. Only requests from a competent U.S. federal jurisdiction, based on a final and unappealable court order, will be considered.
Whenever possible, Actualfeed will inform the user concerned of any disclosure request, allowing them to exercise their rights, including their right to refuse disclosure by invoking the First Amendment (freedom of expression) and Fifth Amendment (protection against self-incrimination) or other constitutional protections. Actualfeed will make every effort to comply with legal requirements while fully respecting the user’s rights to protect their identity within the limits of the law.
3. Intellectual Property Rights
Users retain ownership of any content they post on Actualfeed. By posting content, you grant Actualfeed a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, distribute, publicly display, and adapt the content on the platform, including any future modifications or adaptations.
You also grant Actualfeed the right to pursue any form of plagiarism or copyright infringement concerning content published on the platform, even if Actualfeed is not the original owner of the rights. You warrant that you hold the necessary rights to publish the content and that it does not infringe any copyright, trademark, or other third-party rights. Actualfeed does not claim ownership of user content
4. Limitations of Liability
Actualfeed is provided “as is” without any warranties of any kind, explicit or implied, including implied warranties of merchantability, quality, or fitness for a particular purpose. To the fullest extent permitted by law, Actualfeed shall not be held liable for any losses, damages, or claims arising from the use of the platform, including:
• service interruptions;
• data loss;
• exposure to inaccurate or offensive content posted by users.
Under no circumstances shall our liability exceed the sum of USD 100. Any dispute, claim, or controversy arising from the use of Actualfeed must be resolved exclusively through an amicable resolution or, if necessary, mandatory arbitration as specified in our Dispute Resolution clause, and without recourse to public courts. Failure to initiate arbitration within 30 days of the event giving rise to the claim shall result in the permanent and irrevocable waiver of any right to seek recourse.
5. Changes to Terms
Actualfeed reserves the right to modify these Terms of Use without prior notice. Users will be notified of significant changes, and by continuing to use the platform after such modifications, you agree to the updated terms.
6. Dispute Resolution through Mandatory Arbitration
All disputes, claims, or controversies arising out of the use of Actualfeed, these Terms of Use, or interactions with Actualfeed shall be exclusively submitted to private and confidential arbitration, without recourse to public courts, unless an amicable agreement is reached beforehand.
Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) in English and may be conducted remotely if necessary. Each party will bear its own arbitration costs, and the arbitration decision will be final and binding on both parties. Any arbitration request must be initiated within six months following the event giving rise to the claim, or the right to act will expire.
7. Governing Law and Exclusive Arbitration
These Terms of Use are governed by and interpreted in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute, claim, or controversy arising from these terms shall be resolved exclusively through private and confidential arbitration, as specified in the mandatory arbitration clause included herein. This arbitration clause constitutes the sole and exclusive remedy for any dispute related to the use of Actualfeed, and precludes any recourse to public courts, except where expressly required by law.
8. Indemnification
The user agrees to indemnify and hold harmless Actualfeed, its officers, employees, and partners, from any claim, demand, or damage arising from a breach of these Terms of Use or the rights of third parties.
9. Force Majeure
Actualfeed shall not be held responsible for any failure or delay in fulfilling its obligations due to circumstances beyond its control, such as natural disasters, infrastructure failures, or other unforeseen events.

Governing Language
